Introduction
These Terms and Conditions apply to all plumbing and drain services provided by PeakFlow Plumbing 24 ("the Company," "we," "us," "our") to any customer ("you," "your"). By booking our services or using our website, you agree to these terms.
1. Definitions
- Services: We provide all plumbing, drain, and related work.
- Materials: Any parts, equipment, or goods supplied as part of our services.
- Agreement: The contract is formed when you accept our quotation or request our services.
2. Booking and Appointments
- All appointments must be scheduled in advance. We will confirm your booking by phone, email, or in writing.
- Please ensure safe and reasonable access to the work area at the agreed time.
- If you need to cancel or reschedule, please provide at least 24 hours' notice. Late cancellations or missed appointments may incur a fee.
3. Estimates, Quotes, and Scope of Work
- We may provide free estimates or written quotations. Quotes are valid for 30 days unless stated otherwise.
- The agreed-upon scope of work will be outlined in your quote or service agreement.
- Any changes to the scope of work, including unforeseen issues or client requests, may result in additional charges. These charges will be communicated and agreed upon before proceeding.
4. Fees and Payment
- Fees are based on time, materials, or a fixed quote, as specified in your agreement.
- Payment is due upon completion of the services, unless otherwise agreed upon in writing.
- We accept payment by cash, credit/debit card, or other methods as specified.
- Materials remain our property until fully paid for.
5. Supply of Materials
- We will supply materials as reasonably necessary to complete the services, unless otherwise agreed.
- Title to materials passes to you only upon full payment. Risk in materials passes upon delivery and installation.
6. Standards and Guarantees
- We will provide services with reasonable skill and care and in accordance with industry standards.
- Our workmanship is guaranteed for 6 months. Manufacturer warranties apply to parts and materials.
- This guarantee does not cover faults caused by misuse, neglect, or pre-existing issues.
7. Customer Obligations
- You must provide safe, unobstructed access to the premises and work area.
- You are responsible for obtaining any necessary permits or consents, unless otherwise agreed.
- Please inform us of any known hazards or special site requirements.
8. Liability and Limitations
- We are not liable for pre-existing faults, damage caused by third parties, or issues outside the agreed scope of work.
- Our liability for any claim is limited to the amount paid for the relevant services, except as required by law.
9. Delays and Force Majeure
- We will not be liable for delays caused by factors beyond our control, such as weather, supply chain issues, or emergencies.
- If delays occur, we will reschedule your appointment as soon as possible.
10. Termination
- Either party may terminate the agreement for material breach with written notice.
- Upon termination, you are responsible for payment for all services rendered and materials supplied up to the date of termination.
11. Data Protection
- We handle your personal information in accordance with our Privacy Policy.
12. Governing Law
- These Terms and Conditions are governed by the laws of Canada.
